I'm Kate Buechner and I own über photography Pty Ltd (ABN 71 623 862 975), a family portrait studio at 768 Pacific Highway, Gordon NSW 2072.
This policy explains what information I collect, why I need it and what I do with it. It covers my website, my studio and, most importantly, the photographs I take of you and your family.
I've written it in plain English rather than legal language, because you should be able to read it in a few minutes and know exactly where you stand.
The short version
If you only read one part, read this.
I photograph a lot of children. I take that seriously.
I will never use a photograph of you or your family anywhere public unless you've given me written permission to do so. Not on my website, not on social media, not in an advertisement, not in a competition entry.
If you'd rather your photos stayed private, that's completely fine. Just tell me. Your images will be yours alone and they'll never appear anywhere.
If you gave permission once and you've changed your mind, tell me and I'll take them down.
Everything below is the detail behind that.
What I collect
When you enquire or book
Your name, email address, phone number and postal address. What you're looking for, how many people are coming and whether you're bringing a dog. How you found me.
When you come in for a session
The names and ages of everyone being photographed, including your children. Any notes that help me look after you properly on the day, like a child who's nervous around strangers, a dog who needs a quiet moment, or an access requirement.
For maternity and newborn sessions
Your due date, and your baby's date of birth. I need these to schedule your session at the right point in your pregnancy and to know how old your baby is on the day, which changes how I work. Nothing about your pregnancy or your birth is shared with anyone.
When you order
What you've ordered, your delivery address, and a record of the payment. I don't store your card numbers. Those are handled by the payment providers listed further down.
Photographs
The images from your session. This is the main thing I hold, and there's a section on it below.
When you visit my website
Standard information about your visit, like your IP address, browser, which pages you looked at and how you arrived. There's a section on cookies and tracking below.
Your photographs
Photographs of people are personal information, and photographs of children are the most sensitive information I handle. Here's exactly how it works.
Who owns them
At your ordering session you sign an agreement covering copyright and how images may be used. That agreement is where you decide what I'm allowed to do with your photos.
Using your images publicly
I only use images in my portfolio, on my website, on social media, in advertising or in industry competitions where you've signed that agreement giving permission.
If you haven't given permission, your images are used for one thing only: making the products you've ordered. They stay private.
Changing your mind
You can withdraw permission at any time. Email me at info@uberphotography.com.au and I'll remove the images from my website and my social media accounts within 30 days.
I need to be straight with you about the limits of that. I can't recall anything already printed, already published in a magazine, or already downloaded and shared by someone else. I also can't remove images from a competition archive. What I can do is stop using them from that point on, and remove what's within my control.
Photographing children
I photograph babies, children and teenagers, and I've been doing it for 23 years. Permission for a child's images is given by their parent or guardian.
I never publish a child's surname. I never publish anything identifying where a child lives or goes to school.
Kids Modelling Portfolio sessions
The images from these sessions go to you and nobody else. I don't send them to modelling agencies, I don't submit them anywhere on your behalf and I don't receive anything from anyone in connection with them. What you do with them afterwards is entirely up to you.
Why I collect it
To answer your enquiry and book you in. To photograph your family and look after you well on the day. To produce and deliver what you've ordered. To take payment. To keep in touch about your order and your collection. To send you my newsletter, if you've opted in. To run and improve my website. To meet my tax and record keeping obligations.
That's the complete list. I don't sell your information to anyone, ever, and I never will.
Who I share it with
I keep this list as short as I can. These are the businesses that receive information because I can't run the studio without them.
Businesses that receive your images
Brilliant Prints, an Australian printing lab, for prints and wall art
Seldex, an Australian album maker, for albums
Pixieset, a Canadian company, for delivering your digital files through a password protected gallery
My printing is done in my own studio, prints are sent to my framer Action Framing.
Businesses that receive your contact details
Tave and Go High Level, my booking and client management systems
Acuity Scheduling, for online bookings
Squarespace, my website host
ManyChat, if you've messaged me through Facebook or Instagram
Google and Meta, in connection with website analytics and advertising, described below
My accountant and my bookkeeping software, for financial records
Businesses that handle payments
Stripe and Ezidebit, for online and scheduled payments
Commonwealth Bank, through the card terminal in my studio
Everyone on this list gets only what they need to do their part. None of them are permitted to use your information for their own marketing.
I'll also disclose information where the law requires it. That's rare and I'd tell you if it happened, unless I were prevented from doing so.
Where your information is stored
Your photographs stay in Australia. They're held on drives in my studio, with a backup copy kept in a locked safe at my home. They're not stored in the cloud.
The one exception is the gallery I use to deliver your digital files. Pixieset is a Canadian business and your gallery sits on their servers, which may be located in Canada or elsewhere. Galleries are password protected.
Your contact details are stored overseas. The systems I use to run my business are mostly based in the United States. That means your name, email address, phone number and enquiry details are stored there. The businesses involved are Tave, Go High Level, Acuity Scheduling, Squarespace, ManyChat, Google and Meta.
I've listed this because you're entitled to know, not because anything unusual is happening. It's the same arrangement almost every small business in Australia operates under.
How long I keep things
Images you've ordered are kept indefinitely, so you can reorder prints or products years from now. I can't guarantee this forever, so keep your own backup of any digital files you receive.
Images you didn't order are kept for as long as my storage allows. As storage fills up, older unordered images are deleted without notice. If you'd like unordered images from your session deleted sooner, ask me and I'll do it.
Your contact and order records are kept while you're a client and for at least seven years afterwards, which is what the tax rules require.
Security
I take reasonable steps to protect what I hold.
My computers are password protected. My studio is a locked commercial premises. My backup drive lives in a locked safe at my home. Your digital gallery is password protected. Payment details are handled by the payment providers, not stored by me.
I'll be honest with you about the limit of any promise here. No system is completely secure, and nobody can guarantee otherwise. What I can tell you is that I hold your images on equipment I control rather than scattered across the internet, and that in 23 years I've never had a breach.
If something ever did go wrong in a way that could cause you harm, I'd tell you and I'd tell you quickly.
Marketing emails and messages
I send a newsletter roughly every fortnight via Flodesk. You'll receive it if you're a past client or if you've asked to hear from me.
Every message includes an unsubscribe link. One click and you're off the list, permanently, and it doesn't affect anything else. You can also just reply and tell me, or text me on 0421 577 579.
I don't share my mailing list with anyone.
My website, cookies and tracking
Cookies. My website uses cookies to keep the site working properly, remember your preferences and keep things secure. You can block or delete cookies through your browser settings, though parts of the site may stop working properly if you do.
Google Analytics. I use this to understand how people find and use my website, in aggregate. It tells me which pages are popular. It doesn't tell me who you are.
Meta Pixel. I advertise on Facebook and Instagram, and the Meta Pixel is installed on my website. It records that a visit happened and allows Meta to show my advertising to people who've visited my site or who look similar to my clients. If you'd rather not see it, you can adjust your ad preferences inside your Facebook or Instagram settings.
My website contains links to other sites. Once you click through, you're on their turf and their privacy policy applies, not mine.
Getting access, making corrections, asking for deletion
You can ask me what information I hold about you, and I'll tell you. You can ask me to correct anything that's wrong, and I'll fix it. You can ask me to delete images or information, and I'll do it where I'm able to.
Email info@uberphotography.com.au. I'll respond within 30 days and usually a lot faster than that. There's no charge.
The only things I can't delete are records I'm legally required to keep, like transaction records for tax purposes.
If you're not happy
Tell me first. Email info@uberphotography.com.au or call me on 0421 577 579. It's a small business and it's me you'll be speaking to. I'll acknowledge your complaint within 5 business days and give you an answer within 30 days.
If you're not satisfied with how I've handled it, you can take it to the Office of the Australian Information Commissioner at oaic.gov.au, or by phone on 1300 363 992.
Changes to this policy
If I change this policy, I'll update the date at the top. If it's a substantial change affecting how I use your images, I'll tell my clients directly rather than quietly editing the page.
